These General Conditions and the Travel Instructions form an integral part of the Contract or. a referral/voucher agreement between Funpark Menina (Kamp Menina d.o.o. – hereinafter referred to as Funpark Menina) and the client of the services.
The General Terms and Conditions apply only to services organised by Funpark Menina, unless it is expressly stated that they also apply to the sale of arrangements by other organisers.
In the event that the Specific Terms and Conditions or a particular Programme specifies otherwise with respect to any point of these General Terms and Conditions and the Instructions, the reference or. the provision set out in the programme.
In the case of telephone or internet sales, the Traveller shall be deemed to have accepted the provisions of these General Terms and Conditions when he/she has ordered and confirmed the Funpark Menine services by telephone or by internet via e-mail. The provisions of the General Terms and Conditions and the Instructions may be consulted by the Customer on the Website , where they are specifically marked and generally accessible.
The Customer is any person who has made a valid reservation or made a purchase and payment for the services of Kamp Menina d.o.o. and to whom these General Terms and Conditions and the Instructions for Tourist Arrangements apply.
CANCELLATION OR CHANGE OF TRAVEL BY THE CLIENT
The customer has the right to cancel the service by contacting the person or establishment where the service was ordered. In the event of cancellation by the Customer, Funpark Menina shall be entitled to reimbursement of the cancellation costs. The amount of the reimbursement depends on the time taken by the client to submit the cancellation, which must be in writing. In the event of cancellation, the passenger is obliged to reimburse Funpark Menini for the administrative costs of € 10.00 per person. The amount of the cancellation reimbursement depends on the time before the start date of the service during which the customer submitted the cancellation or otherwise cancelled the trip:
– 45 to 30 days before the start date of the service – 10% of the package price
– 29 to 22 days before the start date of the service – 20% of the package price
– 21 to 15 days before the start date of the service – 30% of the package price
– 14 to 8 days before the start date – 50% of the package price
– 7 to one working day before 20:00 on the day before the start of the service – 80% of the package price
– Cancellation on day of departure or no-show without cancellation 100% of the package price.
Notwithstanding the cancellation charges set out above, these may be higher where the conditions of the travel arrangements dictated by Funpark Menini’s terms and conditions of sale and those of its business partners so require. If the conditions for reimbursement of expenses due to cancellation of a trip are otherwise specified in the programme, the conditions set out in the programme will apply.
Upon cancellation of the Services, the Customer must sign a cancellation document offered by the Seller for signature. If he/she refuses to sign this document, he/she will be deemed not to have cancelled the service.
If the Client interrupts the programme during its execution, the Client shall not be entitled to any reimbursement of costs or purchase price, either in part or in full.
In the event of a change of the programme at the passenger’s own request or due to force majeure, without any reason on the part of Funpark Menina for the incorrect service, the passenger shall not be entitled to claim any compensation or reduction of the price.
CANCELLATION OR CHANGE OF PROGRAMME
Funpark Menina reserves the right to cancel or modify services in accordance with applicable law.
Funpark Menina reserves the right to withdraw from the Contract, in whole or in part, if, prior to or during the implementation of the Programme, extraordinary circumstances arise which could not have been anticipated, removed or avoided and which, for Funpark Menina, constitute a valid reason for not concluding the Contract if they had existed at the time of the conclusion of the Contract.
Funpark Menina may terminate or withdraw from the contract and claim damages from a client who is in direct breach of the provisions of the contract concluded with Funpark Menina, in particular if it is established that the client has deliberately misreported the number of passengers or their age, or if changes have been made in the course of the programme and the client has failed to inform Funpark Menina thereof.
Funpark Menina cannot be held responsible for changes to the programme due to any force majeure during the programme. In these cases, it may provide services to passengers in a modified form, according to the existing possibilities.
In the event that Funpark Menina cancels the service, the subscriber is entitled to a full refund of the price paid for the service ordered.
Funpark Menina is not liable for delays to aircraft, ships, trains or buses, nor for changes to the programme resulting from such delays.
In the event that the situation on site does not allow Funpark Menina to accommodate the Client in the ordered facility, Funpark Menina may accommodate the Client in the same location in another facility of the same category.
SERVICE BILLING
The services shall be invoiced according to the existing offer, which has been approved by the Customer. The Client is obliged to notify any change in the number of participants that deviates from the confirmed offer at least 48 hours before the event and to communicate the final number of participants.
In the event that the number of participants in the event is lower than the number of participants indicated in the confirmed offer, the billing shall be made in accordance with the confirmed offer, and the Client shall not be entitled to reimbursement of the costs resulting from the difference in the number of actual participants, and in the event that the number of participants is higher than the number agreed in the original offer, Funpark Menina may charge additional costs or may withdraw from the contract if it is unable to guarantee adequate security resulting from the nature of the individual activities.
